Terms of Use

These Terms of Use ("Terms") govern your access to and use of TradeBeacon's website, AI assistant, and related services (the "Services"), operated by TradeBeacon ("we", "us", or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who May Use the Services

You must be at least 18 years old to use the Services. By using the Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials. Notify us immediately of any unauthorized use of your account. One account per person; do not share your credentials.

3. Using the Services

You agree not to:

  • Use the Services in violation of any applicable law or regulation.
  • Attempt to reverse engineer, scrape, or extract source models, data, or prompts.
  • Interfere with, disrupt, or overload the Services or circumvent rate limits.
  • Use automated means to access the Services except through any officially documented API.
  • Upload or transmit malware, spam, or content that infringes the rights of others.
  • Use the Services to harass, defraud, or harm another person.
  • Use Output to develop competing large language models or market-intelligence products.

4. Content

Your Input. You retain ownership of the prompts, tickers, watchlists, and other content you submit to the Services ("Input"). You grant us a worldwide, non-exclusive, royalty-free license to use your Input to operate, provide, maintain, and improve the Services.

Our Output. Subject to your compliance with these Terms, we assign to you all rights we may have in the content generated and returned to you by the Services ("Output"). You are responsible for Output and for evaluating its accuracy and appropriateness before relying on it.

5. Not Financial Advice

TradeBeacon is an informational and educational tool and is not a registered investment adviser, broker-dealer, or financial institution. The Services do not provide investment, financial, legal, tax, or accounting advice. Nothing generated by the Services should be construed as a recommendation to buy, sell, or hold any security, or to pursue any particular investment strategy.

Market data surfaced through the Services may be delayed, incomplete, or incorrect. AI-generated responses may contain errors, hallucinations, or outdated information. You should independently verify all information and consult a qualified, licensed financial professional before making any investment decision.

You are solely responsible for your trading and investment decisions and for any resulting gains or losses.

6. Third-Party Content

The Services may display or rely on data from third parties (market data providers, news sources, etc.). We do not endorse and are not responsible for third-party content, and we make no guarantees regarding its availability, accuracy, or timeliness.

7. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Services, Output, or any market data will be accurate, complete, reliable, timely, or suitable for any particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, TradeBeacon and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, trading losses, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Services.

Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

9. Indemnification

You agree to defend, indemnify, and hold harmless TradeBeacon from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your Input, your use of Output, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including for violations of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination (e.g. content license, disclaimers, limitation of liability, indemnification) will survive.

11. Changes to the Services or Terms

We may modify the Services or these Terms at any time. Material changes will be communicated through the Services or by email. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which TradeBeacon is established, without regard to its conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction unless otherwise required by applicable law.
